Terms of Service
1. Acceptance and eligibility
These Terms of Service ("Terms") are an agreement between you and Spot Now LLC, a Delaware limited liability company ("Spot Now," "we," "us"), and govern use of the Spot Now websites and services (the "Platform"). By creating an account or using the Platform you accept these Terms. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account; minors are served through parent, guardian, or authorized-representative accounts with appropriate verification. You are responsible for the accuracy of information you provide and for safeguarding your account credentials.
2. What Spot Now is — and is not
Spot Now is an appointment-discovery and scheduling platform covering three service categories: health care, beauty and grooming, and pet care. Spot Now does not itself provide medical, dental, behavioral-health, pharmacy, diagnostic, wellness, cosmetology, barbering, esthetics, veterinary, animal-grooming, or animal-boarding services. Providers and businesses listed on the Platform are independent organizations solely responsible for the professional services they deliver. Information on the Platform is for general informational and scheduling purposes: nothing in the health directory is medical advice, diagnosis, or treatment, and nothing in the pet directory is veterinary advice, diagnosis, or treatment. Browsing the Platform, searching for services, or booking an appointment does not create a provider-patient, professional-client, or veterinarian-client-patient relationship with Spot Now. Beauty, grooming, and pet-care businesses are not health-care providers, and the health-care-specific documents linked from the Platform (the Notice of Privacy Practices and Telehealth Terms) do not apply to them.
3. Emergencies
The Platform is not for medical emergencies and is not a crisis service. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency department. If you or another person is in immediate danger, call 911 or use the applicable national or local crisis resource. For an animal emergency, contact an emergency veterinary hospital directly — 911 is for people.
4. Booking, availability, and data accuracy
Provider participation, availability, insurance acceptance, and appointment times may change without notice. A displayed appointment time is not a confirmed appointment until confirmation is received from the provider's authoritative scheduling system (or from a provider that has formally delegated scheduling authority). Appointment requests are requests only until the provider responds. Some booking paths redirect you to a provider's own website, where the provider's terms and privacy policy apply. Spot Now labels each listing's verification status and booking capability; you agree not to rely on the Platform for information the Platform identifies as unverified.
5. Cost, insurance, cancellation, and no-shows
Spot Now does not set prices, quote or estimate charges, collect payment, or process refunds. The cost of care, insurance billing, and any amounts you owe are matters between you and the provider, governed by the provider’s own financial and billing policies. Spot Now does not collect or store payment-card information. Cancellation follows the Cancellation Policy and the provider-specific terms disclosed at booking; any charge a provider applies for a late cancellation or no-show is billed and collected by that provider directly.
6. Telehealth
Virtual visits are subject to the Telehealth Terms and Consent, including licensure, patient-location, technology, and consent requirements. Telehealth is not appropriate for every condition.
7. User conduct
You agree not to: misrepresent your identity or authority; book appointments you do not intend to use; scrape, harvest, or republish Platform data; probe or circumvent security controls; submit false provider corrections or fraudulent reviews; use the Platform to harass providers or other users; or use the Platform in violation of applicable law. Spot Now may suspend accounts engaged in abuse, subject to Section 11.
8. Intellectual property and third-party services
The Platform, its design, and its software are protected by intellectual-property laws. Provider names and trademarks belong to their respective owners; their appearance on the Platform does not imply affiliation with, partnership with, or endorsement of Spot Now. Third-party services linked from the Platform are governed by their own terms.
9. Disclaimers and limitation of liability
To the fullest extent permitted by applicable law, the Platform is provided on an “as is” and “as available” basis, and Spot Now disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Spot Now does not warrant that listings, availability, insurance-participation information, or other directory content are complete, current, or error-free, and does not warrant uninterrupted or error-free operation of the Platform.
Spot Now is not liable for the professional services delivered — or not delivered — by independent providers and businesses listed on the Platform, including the outcome of any appointment. To the fullest extent permitted by law, Spot Now’s aggregate liability arising out of or relating to the Platform is limited to one hundred U.S. dollars (US $100), and Spot Now is not liable for indirect, incidental, special, consequential, or punitive damages. Some jurisdictions do not allow certain warranty disclaimers or liability limitations; where a limitation is not permitted, it applies to the greatest extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited or waives rights that cannot lawfully be waived. 10. Disputes and governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that the consumer-protection law of the state where you reside applies where it grants rights that cannot be waived by contract. Before filing any claim, you agree to contact legal@getmyspotnow.com and give Spot Now thirty days to resolve the dispute informally. Subject to the foregoing, disputes are resolved in the state or federal courts located in Delaware, and each party consents to their jurisdiction. [Counsel review: any arbitration or class-action provision is intentionally omitted from this draft and may only be added by counsel.] Nothing in these Terms limits rights that applicable state law grants and does not permit to be waived.
11. Changes, suspension, and termination
Spot Now may update these Terms with notice; material changes are versioned, dated, and presented for acceptance where required. You may close your account at any time; certain records must be retained as described in the Privacy Policy and applicable law. Spot Now may suspend or terminate access for material violations, with a process for appeal where required by law.
